Terms of Use of Gampay

Gampay crypto payment gateway (hereinafter, "Gampay") is a service provided by To do (hereinafter, "To do"), with VAT number To do and registered office at To do.

Please read this document carefully. It covers the various terms and conditions that apply as a result of using Gampay (hereinafter, the "Terms").

Although not part of these terms, the Privacy Policy of Gampay describes how your payment data is processed. We recommend reading it to better understand how we handle your data.

Throughout this document, we will refer to you as "User".

Basic Requirements

To use Gampay, you must:

  • Have reached the minimum legal contracting age.
  • Be able to enter into a legally binding contract with Gampay.

You will also need a device that meets Gampay's system and compatibility requirements (which may change occasionally), internet access, and compatible software. Your ability to use Gampay and its performance may be affected by these factors. The User is responsible for meeting system requirements.

If you do not meet the minimum age, you must have parental or legal guardian permission. Please ask your parent or legal guardian to read these Terms with you.

If you are a parent or legal guardian and allow your child to use Gampay, you must comply with these Terms and are responsible for your child's activity on Gampay, including any transactions made through Gampay.

General Description of Gampay

When making a purchase on a merchant's website, the User may select the Gampay platform as a payment method during checkout. Upon doing so (and with the required integration), the online store will connect with Gampay's payment platform, redirecting the User to it.

On the platform, you will see: the total purchase amount in fiat currency, the equivalent in the selected crypto asset, a QR code, and a wallet address to which you must send payment from your own wallet.

The User must use their own wallet to scan the QR code or manually enter the provided address, and send the funds in their chosen crypto asset (from those supported by Gampay, visible throughout payment and within these Terms).

Once the payment is confirmed on the relevant blockchain, Gampay will process the conversion and transfer the fiat amount to the merchant. The User will then be redirected to the merchant's website (with confirmation) and sent a confirmation email by the merchant.

Payment Method

To make payments via Gampay, you must have your own digital wallet compatible with the crypto assets supported by Gampay, as well as sufficient funds in said wallet to complete the relevant transaction.

For these purposes, and under Article 3(1) of Regulation (EU) 2023/1114 on Markets in Crypto-Assets (MiCA), a crypto-asset is: "a digital representation of a value or right that may be transferred and stored electronically, using distributed ledger technology or similar technology."

Gampay does not provide wallets nor custody of digital assets. The User is solely responsible for managing their own wallet and ensuring funds are available in their preferred supported crypto.

Due to the nature of these assets and blockchain technology, sending funds to the wrong wallet address may result in unrecoverable crypto loss. Please check all information provided by Gampay when making a payment, as Gampay is not responsible for losses caused by User error.

Currently, the currencies supported by Gampay for payments are listed below:

  • BTC
  • ETH
  • AVAX
  • USDC
  • POL

This list may be expanded or reduced at any time, but never after a transaction has been validated with the User.

Complaints System

If the User believes any of their rights have been violated, gampay provides a communication channel via the email included in these Terms and commits to respond to your concerns regarding any alleged rights infringement.

Once all the information is received, Gampay may investigate and resolve the situation, notifying the User of the final decision.

Intellectual and Industrial Property

The User acknowledges and accepts that Gampay is the exclusive owner of all intellectual property, industrial property, or any other rights regarding the platform. This includes, among others, reproduction, distribution, public communication, making available, and transformation rights over the platform and any of its elements, including source code, object code, technical documentation, user manuals, etc., as well as any related or derived elements.

Acceptance of these Terms does not imply the transfer of any intellectual, industrial or other property rights, except for the right to use the platform within these Terms.

Accordingly, the User agrees not to:

  • Duplicate, reproduce, sell, rent, lease, license, distribute, or otherwise use the platform software for any purpose other than as expressly authorized in these Terms.
  • Decompile, modify, reformat, translate, reverse engineer, disassemble, or otherwise access the software's source code, except as expressly permitted by law.
  • Divide or split the platform into different parts or modules for independent use.
  • Alter or remove any intellectual, industrial, or other property rights notices included in the software.
  • Infringe the intellectual, industrial, or other property rights held by Gampay over the platform.
  • Develop computer programs, applications, or other products that perform a similar function to the platform's private area when based on Gampay's intellectual property or knowledge acquired from a contractual relationship with the User.
  • Register brands, trade names, or any other distinctive sign associated with or that could be associated with the platform.

So that Gampay can effectively monitor and defend its intellectual property rights, Gampay may collect information and any data necessary to verify the platform's proper use.

In this sense, the User expressly authorizes Gampay to use information collected during use of the platform as legal evidence of its usage in any legal action or proceeding of any nature, whether against the User or third parties.

Limitation of Liability

The User releases Gampay from any liability that may arise from availability interruptions or platform errors.

Gampay is not obliged to control use of content or services, user identity, or accuracy or truthfulness of data or information supplied, except as required by law.

Gampay may, at its discretion, deny any user access to the platform if there are signs of use contrary to these Terms.

Access limitations may be imposed without prior notice and without Gampay assuming responsibility.

Clause headings are for information only and do not affect or expand the interpretation of these Terms. Gampay may change these conditions in whole or in part at any time, publishing changes the same way these Terms appear or by communicating with users.

If any provision of these Terms is declared null or unenforceable in whole or in part by any competent court or authority, such nullity will not affect the rest of the provisions.

Failure by Gampay to exercise or enforce any right or provision in these Terms will not constitute a waiver unless acknowledged and agreed in writing.

These Terms will be kept electronically by Gampay and permanently available to you.

The User and Gampay will enter into the contract in Spanish, which shall be the interpretation language for these Terms.

Privacy and Data Protection

In accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018, all personal data collected while using the platform will be processed in accordance with our Privacy Policy, which every User must expressly accept in case of providing personal data via the private area of the platform.

Unless otherwise specified, notifications between the User and Gampay will be in writing via email.

gampay makes the following email address available for support and help, as well as to receive comments or concerns during the contracting process or afterwards: support@gampaycrypto.com.

Additionally, the User may consult the contact details for Gampay provided in clause 1 of these Terms.

Applicable Law and Jurisdiction

The sale is considered in Spanish territory, so for any interpretative or contentious issues, Spanish law shall apply and, in the event of a dispute, both parties agree to submit to the courts of the consumer's/User's domicile.

In accordance with Regulation (EU) 524/2013 on online dispute resolution for consumer disputes, if any controversy arises regarding these Terms, the User may turn to the European Commission's Online Dispute Resolution Platform via the following link:
